Can I cancel after 5 days?
Yes. After 5 business days you can pursue cancellation for misrepresentation, fraud, or contract breach under LFPC Articles 32, 35, 73 and 92, plus a PROFECO complaint and a chargeback.
What if I paid with a credit card?
File a chargeback. US cardholders use Regulation Z (TILA); Canadians use FCAC and card-network rules. Disputes are generally allowed within 60–120 days of the statement date.
Does PROFECO actually work?
Yes. PROFECO can summon the developer, who is legally obligated to attend conciliation, and can sanction violators. Many disputes settle there without a lawyer.
What if the contract is in English?
The 5-day right and other LFPC protections still apply to contracts signed in Mexico. A language you didn't understand can also support a misrepresentation claim.
Can I cancel if I'm already home in the US?
Yes. Send your letter by mail and email, file with PROFECO online, and dispute the card charge from home.
What is a chargeback and how do I do it?
A chargeback reverses a card payment. Call your issuer, cite "services not as described/misrepresentation," and submit your contract, cancellation letter, and evidence within your dispute window.
Are timeshare exit companies legitimate?
Many up-front-fee exit and resale companies are scams. You can usually cancel for free yourself; a licensed attorney is the safer paid option.
What if the developer threatens me?
Keep all threats in writing and stay calm. Threats strengthen your PROFECO case. A valid cancellation extinguishes the underlying debt.
Does this work for Canadian tourists?
Yes. The LFPC protects all consumers who sign in Mexico. Canadians can also chargeback under FCAC and card-network rules.
Can I sue in the US?
It is difficult because the contract is governed by Mexican law and signed in Mexico. The practical remedies are the LFPC route, PROFECO, and chargebacks. Consult a lawyer for your specific facts.
How much does it cost to cancel?
The letter and PROFECO filing are free; only certified-mail postage has a small cost. Lawyers and chargeback services are optional.
Will canceling hurt my credit?
A valid cancellation extinguishes the obligation. If the developer reports anyway, dispute it and use your PROFECO record and cancellation evidence.
What documents do I need?
Your contract, proof of payment, the cancellation letter, certified-mail receipt, and any correspondence with the developer.
How long does the whole process take?
A clean 5-day rescission can resolve in weeks. Misrepresentation cases via PROFECO can take weeks to a few months. Chargebacks run in parallel.
